Meaning
Pre-judgment or mid-litigation judicial injunctions freeze, impound, and protect bespoke molds, precision dies, jigs, and fixtures from damage, alteration, or unlawful conversion by a manufacturing supplier. Issued by a people’s court under Article 103 of the Civil Procedure Law of the People’s Republic of China, a tooling preservation order prevents an OEM factory from running unauthorized production batches, transferring equipment to competitor lines, or hiding the assets during a supply contract dispute. The order places the tooling under the formal legal custody of the court, removing the factory’s operational access until substantive ownership and contractual damages are resolved through a final judgment or arbitral award.
Petition Protocol
Applying for emergency judicial intervention requires an applicant to supply absolute identification evidence regarding the physical equipment sought for attachment. A foreign principal filing for a tooling preservation order must present purchase receipts, machine serial numbers, matching asset tags, engineering drawings, and notarized bailment agreements establishing exclusive ownership. The applicant must identify the exact factory floor or warehouse where the tooling resides, often supported by recent audit photographs.
Because Chinese courts do not perform independent discovery, inaccurate descriptions or wrong geographic listings result in procedural rejection. Submitting an application requires simultaneous provision of financial security through a cash bond or guarantee insurance policy.
Execution Realities
Court marshals proceed directly to the processing facility to execute the judicial mandate once the preservation petition is accepted. Under the authority of the tooling preservation order, execution officers affix court seals over the equipment control systems, remove critical electronic controllers, or place physical locks on the tooling frames. In situations where continued presence inside the hostile factory threatens mold safety, the court authorizes physical asset removal to an independent, climate-controlled third-party warehouse.
Marshals inventory all associated components, including hot-runner cables, cooling manifolds, and technical stamping plates, logging the full setup into the judicial record to prevent missing auxiliary pieces.
Wrongful Application
Petitioners face strict legal exposure if the underlying commercial claim is ultimately dismissed or judged frivolous by the trial court. A wrongfully executed tooling preservation order halts entire production runs, causing direct business interruption and substantial economic damages for which the applicant is strictly liable under Article 108 of the Civil Procedure Law. The target supplier can petition the court for an immediate compensation award, collecting damages directly from the applicant’s posted cash bond or litigation preservation insurance policy.
Foreign companies must calibrate legal action carefully, verifying contractual breach, delivery records, and mold ownership documentation before seeking severe injunctive intervention against an operational factory floor.
