Warranty Breach
Legal claims for damages often center on whether a failure resulted from normal wear or from a pre-existing latent defect. Under the Civil Code of the People’s Republic of China, a seller is liable for flaws that existed at the time of delivery even if they were not discovered until much later. The buyer must prove that the failure originated from a manufacturing error rather than from misuse or environmental stress.
Inspection Limitation
Quality assurance processes like automated optical inspection or x-ray can identify visible errors but cannot see every internal material weakness. Manufacturers use accelerated life testing to force a latent defect to appear before the product leaves the factory. These tests involve high temperature, humidity and vibration to simulate years of operational use.
Liability Term
Temporal limits on responsibility are defined by the statute of repose or the contractual warranty period. A latent defect that emerges after the expiration of the legal period may not be eligible for a remedy unless the buyer can prove the seller intentionally concealed the flaw. Disputes regarding high value industrial equipment often require forensic analysis by a third party laboratory to determine the root cause of the failure.
