Meaning
Judicial implementation procedures convert an effective judgment, arbitral award or notarized debt instrument into tangible recovery by seizing and liquidating an obligor’s non-exempt wealth. In the Chinese legal framework, asset execution is governed by the Civil Procedure Law and administered through dedicated enforcement divisions of the People’s Courts. The process commences upon formal filing by a creditor holding a valid enforcement title against a non-compliant debtor.
Court enforcement officers utilize automated investigative databases connected to state banks, the Ministry of Natural Resources and the State Administration for Market Regulation to discover liquid assets, equity holdings and real property. The boundary of execution terminates at assets necessary for basic debtor survival and property lawfully assigned or shielded under third-party trust exemptions.
Inquiry Channel
Court enforcement divisions identify liquid holdings through centralized state infrastructure. The Supreme People’s Court operates the online inquiry and control system, linking municipal benches with commercial banks, land registries and vehicle databases. An investigator enters debtor credit coordinates into this interface to trigger administrative freezes on identified accounts within minutes.
Bank balances freeze without prior notice to the debtor. Company bank accounts, vehicles, manufacturing machinery and corporate shareholdings become subject to court control through direct administrative notifications issued by the court to registries and banks.
Liquidation Method
Properties seized under formal execution orders pass through statutory valuation and public sale channels. People’s Courts typically mandate valuation via online public assessment platforms before listing assets on authorized internet auction networks, such as judicial auction services operated by domestic platforms. The initial auction floor price cannot sit below seventy percent of assessed valuation.
If the initial auction fails due to absence of bidders, a secondary auction with a lower reserve proceeds. When real property or plant machinery fails to sell across two successive auctions, the court invites the petitioning creditor to accept the physical assets in lieu of debt satisfaction at the reserve price.
Remedy Exhaustion
Recovery proceedings conclude when realisable debtor holdings are fully exhausted or debts are satisfied. When investigations show no liquid capital, real estate or auctionable assets, the court issues a ruling terminating the specific execution procedure. Debtor enterprises are placed onto the list of dishonest judgment debtors, restricting legal representatives from air travel, high-speed rail travel and hotel stays.
Creditors retain the right to reinstate asset execution if new property comes to light within the statutory limitation period. Alternatively, the court may convert the judgment debtor into corporate bankruptcy proceedings to liquidate remaining factory scrap or residual equity.
