Reporting Window
Effectiveness of a disclosure depends entirely on its timing relative to official actions. A report is only considered voluntary if it is made before customs has notified the company of an upcoming audit or has already discovered the non-compliance. Once the authorities have initiated a formal inquiry, the opportunity for voluntary disclosure is closed.
Companies must conduct regular internal reviews to identify errors quickly and submit the report while the window remains open.
Fine Mitigation
Successful disclosure often leads to the waiver or reduction of administrative penalties. If the violation is minor and the tax shortfall is paid promptly, the authorities may choose not to impose any fine at all.
