Procedural review conducted by the China National Intellectual Property Administration ensures that an application for a utility model patent meets all administrative and clerical requirements. Utility model formality examination is the only mandatory check that these types of patent applications undergo before they are granted and published. Unlike invention patents, utility models do not face a substantive examination of their novelty, inventiveness or industrial applicability during this initial stage.
The examiner focuses on the completeness of the documents, the clarity of the drawings and the payment of the required filing fees. This process is governed by the Patent Law and the detailed Implementing Regulations, and it typically takes six to twelve months to complete. Because the bar is so low, a vast majority of utility model applications are granted if the paperwork is correct.
This leads to a fast-track for obtaining an enforceable intellectual property right, although the strength of that right is much lower than that of a fully examined invention patent.
Administrative Check
Officers verify that the application includes a request, a description, a set of claims and the necessary drawings as required for any technical solution. They also check that the subject matter is eligible for utility model protection, which must be a physical product with a definite shape and structure rather than a chemical process or a software algorithm. If the application contains obvious errors, such as missing pages or illegible text, the applicant is given a chance to correct them.
Once these formal requirements are met, the CNIPA issues a grant notice and a patent certificate. This administrative efficiency is what makes the utility model system so popular among Chinese manufacturers.
Legal Effect
Granting of the patent through this formality check provides the owner with the right to sue for infringement and to request customs detentions. However, if the owner decides to litigate, they must often provide a Patent Evaluation Report from the CNIPA to prove that the patent is actually valid. This report is a retrospective substantive examination that checks the patent against prior art.
Without this report, a court might stay the infringement case if the defendant files an invalidation request. This two-step process balances the need for speed in the application phase with the need for accuracy in the enforcement phase.
Strategy Role
Companies use the speed of the formality examination to quickly build a defensive patent portfolio that can be used to deter competitors. Because it is so easy to pass the formality check, a company can file dozens of utility models for a single product to create a thicket of protection. This can be a very effective way to manage a market, as competitors must spend time and money to invalidate each individual right.
