Meaning
Administrative legal process serves to formally challenge, re-examine, and potentially revoke an already granted patent that fails to meet statutory requirements of novelty, inventiveness, or utility. A patent invalidation proceeding is conducted exclusively before the Reexamination and Invalidation Department of the Patent Office under the China National Intellectual Property Administration. The procedure applies uniformly across invention patents, utility models, and design rights, determining whether the initial state grant was procedurally and substantively valid, but it does not resolve independent questions of commercial damages or civil infringement.
Filing Mechanism
Any corporate entity, trade organization, or private individual can initiate invalidation actions at any time after the official grant announcement of a Chinese patent. Initiating a patent invalidation proceeding requires the petitioning party to submit a structured petition identifying specific statutory grounds alongside verifiable, prior-art evidence. Claimants must provide certified copies of public publications, domestic patent records, or proof of prior commercial use predating the challenged patent’s initial filing date.
Foreign language evidentiary exhibits require complete Chinese translations certified by qualified translation agencies within strict administrative timelines. The patent holder receives formal notification of the petition and is granted a fixed window to submit legal counterarguments or restricted claim amendments.
Oral Hearing
Substantive determination of validity centers upon a formal oral hearing held before an administrative collegiate panel consisting of three to five technical examination officers. Panelists question both parties concerning technical characteristics, prior-art disclosures, and the inventiveness thresholds established in the national Patent Examination Guidelines. The patent owner may narrow patent claims to survive the validity challenge, provided that such modifications do not exceed the scope of the original patent description.
Technical experts and patent agents argue the boundaries of utility model claims with specific intensity, given that these rights undergo no examination for novelty prior to registration. At the conclusion of deliberations, the administrative board issues a formal written Patent Invalidation Decision declaring the patent fully valid, partially invalid, or entirely void.
Judicial Appeal
Parties dissatisfied with the administrative outcome maintain the statutory right to appeal the decision by filing an administrative lawsuit against CNIPA. The Beijing Intellectual Property Court exercises exclusive first-instance jurisdiction over all appeals arising from administrative validity determinations. This litigation names the state patent reexamination authority as the defendant, while the counterparty from the original invalidation enters proceedings as a third party.
Appeals from the Beijing Intellectual Property Court proceed directly to the Intellectual Property Tribunal of the Supreme People’s Court, bypassing local high courts entirely to maintain national judicial consistency. A final ruling revoking patent claims invalidates the property right from its original filing date, rendering preceding civil infringement actions legally baseless.
