Financial funds are generated from the public court-ordered sale of a debtor’s seized assets to satisfy outstanding liabilities. The distribution of judicial auction proceeds in China is governed by execution rules that establish the priority of different classes of creditors.
Distribution Priority
Division of funds generated from the court sale of seized assets follows a strict hierarchy of claims. Secured creditors who have registered their interests over the auctioned machinery are paid first from the judicial auction proceeds of that specific asset. If multiple security interests exist, the funds are distributed in the chronological order of their registration timestamp.
Unsecured creditors and general claimants are only paid from any remaining funds after all secured obligations have been fully settled.
Execution Process
Administrative and judicial steps must be completed by the court before any distribution of the sale proceeds can occur. The court coordinates the seizure, appraisal, and online auction of the equipment, which is usually held on a designated public platform. Once the auction succeeds, the winning bidder must deposit the full price into the court’s designated bank account.
The court then reviews the claims filed by the creditors, computes the distribution plan, and issues payments to the verified claimants.
Surplus Allocation
Disposal of any remaining funds after the satisfaction of all secured and execution costs is governed by specific legal procedures. If the judicial auction proceeds exceed the total amount owed to the secured parties, the surplus is returned to the debtor or used to pay unsecured creditors. When the proceeds are insufficient to cover the primary secured debt, the unpaid balance remains as a general unsecured claim against the debtor’s other assets.
