A formal judicial order temporarily halts the compulsory enforcement of a finalized court judgment or an arbitral award. Courts issue an execution suspension ruling as a procedural instrument to pause the seizure or auction of assets during a legal dispute. This ruling typically occurs when a party provides a legitimate reason for the delay, such as the discovery of new evidence or the initiation of a retrial process.
The primary function of an execution suspension ruling is to prevent irreparable harm that might occur if a judgment is enforced before a pending legal challenge is resolved. It operates under the framework of the PRC Civil Procedure Law, which defines the specific circumstances under which enforcement officers must cease their activities.
Security Requirement
The court generally demands that the party seeking the stay provide a form of guarantee to protect the interests of the judgment creditor. This security often takes the shape of a cash deposit, a bank guarantee or a lien on real property that equals the value of the judgment debt. If the execution suspension ruling is later lifted and the original judgment stands, the creditor can immediately access these secured assets to satisfy the claim.
Failure to provide adequate security usually leads to the immediate dismissal of the application for suspension.
Judicial Discretion
Judges evaluate several factors before granting the order, including the likelihood of success in the underlying appeal and the potential impact on the local economy. An execution suspension ruling is not an automatic right and requires a showing of a clear statutory ground for the pause. The court must balance the right of the creditor to a timely settlement against the right of the debtor to a fair review of the case.

Once the reason for the pause is resolved, such as the conclusion of a retrial, the execution suspension ruling is formally vacated. Enforcement then resumes from the point where it was interrupted, and the court may add interest or penalties for the delay if the debtor acted in bad faith.
