Meaning
Insurance or bank instruments guarantee that a contractor will complete a project according to the agreed specifications and timelines. An execution performance bond provides the project owner with a financial remedy if the builder abandons the site or fails to meet the quality standards defined in the contract. This type of security is mandatory for most public works projects in China under the national bidding laws.
Project Security
Owners use these bonds to ensure that a replacement contractor can be hired without additional cost to the public budget. The presence of an execution performance bond reduces the risk of long-term delays in infrastructure development.
Financial Penalty
Payouts are typically capped at a percentage of the total contract value, often ranging from five to ten percent. If a default occurs, the surety or bank pays the owner the amount necessary to cover the immediate losses.
Completion Certificate
Obligations under the security remain in effect until the project passes a final inspection and a formal handover document is signed. Once the warranty period begins, the original bond is usually replaced by a smaller maintenance guarantee. Releasing the funds requires a clear statement from the owner that all contractual milestones have been met.
This transition marks the end of the risk period for the financial institution.
