This pool acts as a guarantee that if the court order is found to be wrongfully requested, the innocent target of the freeze can be compensated for their resulting business losses.
The arrangement continues until the court either discharges the security because the freeze was appropriate or until the funds are used to pay damages.

For the party being targeted by the freeze, the knowledge that an equivalent sum is waiting in escrow provides a path to remedy that avoids further extensive litigation.
Insurance companies frequently participate by providing a bond that sits in the escrow place of cash, allowing businesses to maintain liquidity while still meeting the court’s demands. However, if a bond is not accepted, the capital lock-up can be a significant hurdle for smaller firms with tight cash flows. The existence of the account effectively filters out speculative or malicious filings that lack substantial financial backing.
Functional Limit
Bound limits define that these funds cannot be used to pay for the court’s general operational expenses or unrelated fees. Because counter-security escrow is tied to a specific preservation order, it cannot be seized by the general creditors of the party who placed it there. Its existence is legally ring-fenced to focus purely on the risks associated with the specific injunction requested in that case.
Once the case is closed or the property freeze is lifted by mutual agreement, the status of the escrow must be resolved within a standard timeframe set by local practice rules. If no damages are claimed within six months of the injunction’s end, the money is usually returned as a matter of routine. The final purpose of the account is to act as a stabilizer for the commercial environment during high-stakes legal interventions.
