Valuation Requirement
Judicial officers determine the necessary amount based on the value of the assets being frozen or the potential loss to the business. A cash security bond typically equals the full value of the property preservation request in some provinces. In other regions, the court may accept a lower percentage if the evidence for the claim is exceptionally strong.
Custody Management
Money must be transferred to a designated judicial account managed by the accounting department of the local People’s Court. The cash security bond remains in this interest bearing account until the litigation concludes or the preservation order is lifted. Proof of payment is required before the enforcement officers move to seal factory equipment or freeze bank accounts.
Return Mechanism
Release of the funds occurs only after the final verdict is reached and any awarded damages are settled. If the plaintiff wins, the cash security bond is returned in full once the enforcement phase begins. If the plaintiff loses, the defendant may file a claim against the bond to recover losses resulting from the business interruption.
