While the benchmark rate surcharge appears in private loan agreements, the Pricing Self-Discipline Mechanism limits the maximum deviation from the Loan Prime Rate to ensure market stability across the banking sector. Financial institutions must submit detailed reports justifying any deviation from the published reference rates during annual compliance reviews.

Operational Calculation
Carriers use specific formulas based on average bunker prices or currency fluctuations over a preceding quarter. If the average price of low sulfur fuel oil stays within a set band, the benchmark rate surcharge remains static. Movement beyond this band triggers an automatic increment.
Contractual Limitation
Shipper agreements often define the frequency and notice period for price changes. A benchmark rate surcharge that changes without forty five days of prior notice might breach specific maritime transport regulations. Documentation must show the underlying index data.
