Meaning
Statutory preference rule establishing that a possessory lien over movable property takes priority over previously registered mortgages or perfected pledges over the same asset. Under Chinese civil law, article 456 protects service providers, repair shops and logistics operators who perform physical work or transport services that maintain or enhance collateral value. A repair facility or carrier holding lawful physical possession of machinery or cargo retains statutory lien rights until outstanding service fees receive settlement.
The statutory mandate elevates this possessory lien above prior mortgages registered on the central publicity platform or pledges created through delivery. Priority holds regardless of whether the statutory lienholder knew of the pre-existing mortgage or pledge at the time service performance commenced.
Value Protection
Labor and preservation efforts conducted by service providers provide the legal justification for subordinating senior financial creditors. Under article 456, a factory repair shop that overhauls imported industrial equipment holds a priority claim over the auction proceeds of that equipment superior to the primary lending bank. Foreign equipment lessors and secured financiers must anticipate that unpaid domestic maintenance or storage claims will take top tier distribution status upon default.
The statutory priority applies strictly to claims directly arising from the repair, processing, storage or transportation of the specific chattel.
Possession Retention
Continuous physical possession serves as an indispensable requirement for maintaining statutory lien priority under article 456. Voluntarily surrendering control of the repaired or stored asset to the owner or a third party instantly extinguishes the possessory lien. Once possession is lost, the service provider claim converts into an unsecured contractual obligation that ranks behind all registered security interests.
Forced or fraudulent loss of possession does not extinguish the lien if the holder promptly initiates legal action to recover physical custody.
Enforcement Distribution
Judicial execution proceeds generated from auctioning encumbered chattels satisfy possessory lien claims before any funds disburse to registered mortgagees or pledgees. Court enforcement divisions verify service contracts and invoices to ensure claims fall strictly within statutory limits before authorising top-priority payout.
