Under article 103 prc civil procedure law, courts may order the preservation of a respondent’s property or specific behavior when the conduct of the respondent or other reasons make a judgment difficult to execute. The measure prevents the dissipation of assets or evidence during ongoing disputes.
Asset Freezing
The execution of a court order under this provision involves the cooperation of banks, registries, and local agencies. These third parties must freeze bank accounts, seal real estate, or restrict equity transfers upon receiving the civil ruling. The court determines the specific scope of assets based on the amount claimed in the lawsuit.
Compensation Security
The applicant must provide a guarantee to cover potential losses suffered by the respondent if the application is wrongful. This security typically takes the form of cash, a bank guarantee, or litigation preservation insurance. If the court eventually finds that the plaintiff holds no valid claim, the security pays for the damage caused by the asset freeze.
Procedural Requirement
Urgent circumstances allow for the filing of an application before a formal lawsuit begins. The court must make a ruling within forty-eight hours of receiving the application, and the preservation measures begin immediately. If the applicant does not file a lawsuit or initiate arbitration within thirty days after the preservation measures are taken, the court must lift the preservation.
This protective window ensures that defendants do not suffer from indefinite asset freezes without active legal proceedings.
