Neutral Arbitration
Commercial arbitration under the China International Economic and Trade Arbitration Commission often relies on independent quality reports to settle contract disputes. When a buyer claims that a shipment is defective, the arbitration panel can order third-party escrow testing to obtain an unbiased evaluation of the product. The laboratory used for this testing must be accredited by the China National Accreditation Service for Conformity Assessment to ensure its findings are legally binding.
These reports are recognized by Chinese courts as primary evidence in product liability cases.
Laboratory Custody
Maintaining a secure chain of custody is essential to prevent the supplier or buyer from tampering with the test samples. The neutral warehouse operator must supervise the selection of the samples and transfer them directly to the testing laboratory. During the third-party escrow testing, the remaining cargo is kept in a secure zone that cannot be accessed by either party without joint authorization.

Award Settlement
Contracts that incorporate independent quality checks should specify how the escrow agent will distribute the funds based on the laboratory report. If the goods fail the test, the funds are returned to the buyer and the supplier must take back the defective materials.
This arrangement protects the buyer from the financial risk of paying for useless products and having to sue for a refund in a foreign court. It also provides the supplier with a guarantee that they will be paid promptly if they deliver the specified quality.
