These subrogation rights typically arise in the context of insurance or guarantees when one entity pays a debt that was primarily owed by another. This mechanism ensures that the party who settled the loss can seek reimbursement from the person or entity actually responsible for the damage.
Insurance Practice
Property and cargo insurers exercise these powers after they have compensated a policyholder for a loss caused by a carrier or warehouse operator. Once the claim is paid, subrogation rights transfer the legal interest from the insured party to the insurance company. This transfer allows the insurer to initiate litigation in its own name to recover the payout.
Statutory Basis
The Civil Code and the Insurance Law of the People’s Republic of China provide the framework for the automatic transfer of these claims. Because subrogation rights are created by the act of payment, no separate assignment agreement is strictly necessary between the victim and the insurer. The law prevents the responsible party from escaping liability simply because the victim was insured.
Operational Limit
A party can only recover up to the amount it has actually paid to the original claimant. Although subrogation rights allow for the pursuit of the full value of the debt, the subrogee cannot profit from the transaction. This principle ensures that the process remains a tool for indemnity rather than a speculative legal venture.
