Meaning
Monetary calculation of the additional sums owed by a debtor due to the delayed payment of a legal debt. The post-award interest calculation begins on the day the payment deadline in the award passes and continues until the full amount is transferred to the creditor. Under Article 260 of the Civil Procedure Law of the People’s Republic of China, the rate for this interest is often doubled for the period of the delay.
This mechanism creates a significant financial incentive for the losing party to comply with the ruling immediately.
Compounding Method
Calculation follows the specific formula set out in the judicial interpretations of the Supreme People’s Court. The post-award interest calculation typically uses a simple interest approach unless the underlying contract or the award itself specifies compounding. It applies to the principal amount and the legal costs.
Statutory Penalty
Debtors who fail to pay within the period specified in the award face a debt interest rate that is effectively a penalty for non-compliance. In the post-award interest calculation, the daily rate is calculated as 0.0175 percent of the unpaid amount. This rate applies specifically to the portion of the debt that remains unpaid after the grace period.
The court calculates this sum automatically during the execution phase without requiring a separate lawsuit. This specific rate is fixed by law and does not fluctuate with the market unless the statute is amended.
Execution Delay
Duration of the payment lag is the primary variable in determining the final sum. The post-award interest calculation stops only when the court confirms that the funds have reached the account of the creditor or have been deposited with the court. Disputes over the exact end date are resolved by looking at the bank transfer records or the court’s receipt.
