Meaning
Enforcement mechanism used to freeze or seize the assets of a debtor following the issuance of a final judgment or arbitral award. The post-award attachment functions to secure the value of the award during the period between the conclusion of the hearing and the actual transfer of funds. In the context of Chinese civil procedure, this step often involves an application to the Intermediate People’s Court at the place where the property is located.
It converts a theoretical legal right into a physical hold on bank accounts or physical assets.
Asset Seizure
Priority is given to liquid assets such as cash deposits and tradable securities. When a post-award attachment is executed, the court issues a notice to the relevant bank or registry to block any further transactions involving the property. This prevents the debtor from moving assets to other jurisdictions or hiding them through shell companies.
Jurisdictional Venue
Filing the application must occur in the court with authority over the assets or the debtor’s domicile. For a foreign party seeking a post-award attachment in China, the process involves providing a notarized and legalized version of the award along with a Chinese translation. The court verifies that the award is final and enforceable under local law or international treaties.
If the assets are located in multiple cities, the applicant might need to coordinate with several local courts to ensure a comprehensive freeze.
Remedy Finality
Execution of the seized property occurs through an auction or a direct transfer if the debtor fails to pay the debt within the time specified by the court. The post-award attachment remains in place until the obligation is fully satisfied or the court orders a release. This procedure is the final stage of the recovery process for a creditor.
