Meaning
Legal proceedings allowing parties to present verbal arguments and evidence before an administrative tribunal constitute a critical stage in the adjudication of patent validity in China. An oral hearing is typically requested during invalidation or re-examination cases handled by the Patent Re-examination and Invalidation Department. This session allows the panel of examiners to ask direct questions and clarify technical points that are not fully explained in the written submissions.
Tribunal Session
Rules of conduct for the meeting are strictly enforced by a panel consisting of three or five administrative judges. The oral hearing begins with the petitioner stating the grounds for invalidity or the applicant defending their claims. Each side is given a specific amount of time to present their case and respond to the arguments of the opposition.
Evidence Cross-examination
Verification of the authenticity and relevance of the submitted documents takes place during the middle phase of the proceeding. During the oral hearing, parties may introduce physical samples or demonstrate the operation of a device to the panel. Opposing counsel has the right to challenge the data and point out inconsistencies in the testimony.
Adjudication Protocol
Deliberations by the panel occur in private after the verbal session has concluded. The oral hearing does not result in an immediate decision, but the record of the proceedings forms a part of the final written ruling. Parties receive the formal result by mail several weeks after the conclusion of the session.
