Enforcement Limitation
If a default occurs and the foreign lender seeks to enforce the guarantee, the perfection status determines whether the court will allow the liquidation of domestic assets for remittance. Courts will recognize the claim but will refuse to authorize the actual remittance of funds if the registration was never perfected. Furthermore, the guarantor may face administrative penalties from the foreign exchange authority for failing to comply with the mandatory filing timelines.
