Meaning
Occurring during the enforcement phase of a judicial decision, the physical immobilization of production equipment prevents the debtor from continuing industrial operations. A machinery sealing order authorizes the court to apply paper strips and wax seals to essential factory components. These markings serve as a public notice that the equipment is under the custody of the people’s court.
Physical Attachment
Judicial officers visit the factory site to identify the specific assets listed in the court directive. During the execution of a machinery sealing order, the officers place seals on power switches, control panels, or structural frames. Tampering with these seals is a criminal offense that leads to fines or imprisonment.
Operational Restriction
Prohibiting the use of industrial assets ensures that their value does not depreciate through wear and tear during the dispute. A machinery sealing order usually stops the entire production line if the sealed equipment is a bottleneck in the manufacturing process. This creates significant pressure on the factory owner to settle the outstanding debt or provide alternative security.
The court may occasionally allow a soft seal, where the machine remains operable but cannot be moved or sold, though this is rare in high-conflict cases. The choice between a hard seal and a soft seal depends on the likelihood of the asset being damaged or hidden.
Legal Custody
Responsibility for the safety of the equipment shifts to the court or a designated custodian until the order is lifted. A machinery sealing order creates a period where the debtor is the mere caretaker of the assets without the right to utilize them. This state continues until the auction of the machinery or the payment of the judgment debt.
