In China, the State Taxation Administration manages the process under the authority of the law on the administration of tax collection.

Application Protocol
Initiation of the procedure starts with a formal request from the taxpayer to all involved tax jurisdictions. Participants must submit detailed economic analyses and historical data to justify the proposed pricing methodology. The tax authorities then enter into a mutual agreement procedure to reach a consensus on the arm’s length price.
This stage often involves technical discussions regarding comparable company data and profit split methods.
Audit Protection
Approval of the agreement grants the enterprise immunity from transfer pricing audits for the specific transactions covered during the term. As long as the company adheres to the agreed pricing and meets the critical assumptions, the tax authorities will not adjust its reported profits. Price stability allows for more accurate financial planning and reduces the costs associated with tax disputes.
If the business environment changes so significantly that the critical assumptions are no longer met, the parties must renegotiate or cancel the deal.
Renewal Logic
Extension of the arrangement requires a fresh review of the market conditions and the company’s performance. The taxpayer should submit a renewal application before the existing term expires to maintain continuous coverage.
