Meaning
Second level of the Chinese judiciary handles major foreign-related cases and appeals from primary-level courts within a specific municipal or prefectural jurisdiction. An intermediate court serves as the trial court for civil disputes where the amount in controversy exceeds the local threshold or involves significant foreign interests. It also functions as the appellate body for the majority of routine commercial cases.
The court maintains specialized divisions for intellectual property, environment and maritime law.
Original Jurisdiction
Trial authority is granted for cases that have a substantial impact on the local economy or involve complex legal questions. When a foreign investor initiates a lawsuit against a local manufacturer, the intermediate court often holds the initial hearing to ensure a higher degree of professional oversight. This level of the judiciary possesses the resources to handle cases involving international treaties and cross-border evidence.
Decisions made at this stage are subject to one level of appeal.
Appellate Review
Appellate authority grants the court the power to review judgments issued by lower courts to ensure the correct application of the law. When a party appeals a decision from a primary court, the intermediate court conducts a second trial that may involve a review of both facts and legal reasoning. This process is final for most civil matters under the two-trial system of the country.
A ruling here can only be challenged through an extraordinary supervision procedure at the provincial level.
Judicial Management
Administrative oversight within the court includes the supervision of enforcement offices at the primary level to prevent local interference. The intermediate court manages the distribution of complex cases to ensure that judges with specialized knowledge handle technical industrial disputes. This organizational role helps maintain consistency in how national laws are applied across different districts.
It coordinates with higher courts to implement new judicial interpretations.
