Meaning
Financial recovery mechanisms allow buyers to offset the costs of shipping errors directly from the amount owed to a supplier. A freight chargeback occurs when a manufacturer fails to follow the agreed logistics instructions, such as using an unapproved carrier or missing a shipping window. It governs the allocation of unexpected transportation expenses and encourages compliance with the delivery schedule.
This right to deduct funds is limited by the specific terms of the purchase order and the applicable incoterms.
Cost Recovery
Errors in packaging that lead to increased dimensional weight or the use of premium air freight to correct a production delay are common triggers for these penalties. The buyer calculates the difference between the planned shipping cost and the actual cost incurred due to the supplier’s deviation. This amount is then subtracted from the next invoice payment.
Contractual Right
Chinese commercial law recognizes the validity of these deductions when they are clearly defined as liquidated damages for breach of logistics protocols. The contract must specify the administrative fees and the method of calculation to prevent the chargeback from being viewed as an arbitrary penalty.
Settlement Process
Suppliers have a limited time to dispute the claim by providing evidence that the shipping error was caused by the buyer or a third party. If no dispute is filed within the window, the deduction is considered final.
