Document Accuracy
Beneficiaries must present a written statement that exactly matches the wording required by the instrument. Precision is mandatory. If a demand guarantee conditions specify a certain office for delivery, a claim sent to a different branch will be rejected.
Expiry Limit
Payment obligations cease immediately upon the date or event defined in the contract. Time is absolute. A bank will not honor a request for funds if the presentation occurs even one day after the specified window has closed.
Judicial Stay
Courts in China may issue an injunction to stop a payment if there is evidence of gross fraud. This happens when the beneficiary makes a claim despite knowing that the goods were never shipped or the contract was never signed. Evidence must be clear.
A judge will only intervene if the fraud is clear and the harm to the applicant is irreparable. The applicant must provide a substantial bond to the court before such a stay is granted. This mechanism prevents the abuse of the independent nature of the bank’s commitment.
