Meaning
The designated governmental body or official is responsible for administering and implementing tax treaties, resolving international tax disputes, and negotiating advance pricing agreements with foreign treaty partners. In China, this competent authority is the State Taxation Administration, which holds the exclusive legal mandate to represent the Chinese government in mutual agreement procedures and tax information exchanges. The jurisdiction of this authority applies to all matters arising from bilateral double taxation treaties and international tax conventions, and it stops applying once a formal agreement is reached or the dispute is referred to domestic courts.
Dispute Resolution
When a multinational enterprise faces double taxation or transfer pricing adjustments, it can request the assistance of the authority to initiate a mutual agreement procedure. This process begins when the taxpayer submits a formal petition detailing the double taxation issue and demonstrating that the actions of one or both tax administrations have resulted in taxation not in accordance with the treaty. The authority reviews the petition to determine its validity and decide if it can resolve the issue unilaterally.
If a unilateral resolution is not possible, the authority engages in bilateral negotiations with the counterpart of the treaty partner to find a mutually acceptable solution. These negotiations are aimed at allocating the taxing rights and transfer pricing adjustments between the two jurisdictions in a fair manner. The final agreement reached by the authorities is binding on both tax administrations and must be implemented by the local tax offices, providing a direct remedy for the taxpayer.
Information Exchange
In addition to dispute resolution, the authority plays a vital role in the exchange of tax information with foreign tax administrations to combat tax evasion and avoidance. This exchange of information can occur automatically, upon request, or spontaneously, depending on the terms of the applicable tax treaty or international convention. Under the Common Reporting Standard and the Foreign Account Tax Compliance Act, the authority collects financial account information of foreign residents in China and transmits it to the respective tax administrations.
The authority also receives information on Chinese residents holding financial accounts abroad, which it uses to conduct risk assessments and tax audits. This international cooperation enhances the transparency of cross-border financial transactions and ensures that taxpayers comply with their tax obligations in all relevant jurisdictions.
Advance Pricing Agreements
The authority is also responsible for negotiating and signing bilateral advance pricing agreements with foreign tax administrations to provide transfer pricing certainty for taxpayers. This process involves a detailed evaluation of the taxpayer’s business model, functional profile, and transfer pricing methodology to ensure they comply with the arm’s length principle. The authority works closely with the foreign tax administration to reach a consensus on the appropriate transfer pricing method and critical assumptions for the covered transactions.
Once the agreement is signed, the authority monitors the taxpayer’s compliance through annual reports and coordinates with local tax bureaus to ensure the agreement is applied correctly. This proactive approach helps to prevent transfer pricing disputes and fosters a stable tax environment for multinational enterprises.
