Scope Exclusion
Specific limits on the volume of records determine whether an enterprise can rely on these simplified procedures. To qualify for commercial contract exemptions, the data handler must have processed the personal information of fewer than one hundred thousand individuals since the start of the preceding year. This numerical limit prevents large-scale data processors from avoiding the more rigorous government security assessments.
If the volume of records exceeds this limit, the standard approval pathway becomes mandatory.
Compliance Requirement
Administrative filings remain a critical step even when the transaction is exempt from the full state-level security assessment. To validate the commercial contract exemptions, the data controller must submit the executed standard contract along with an impact assessment report to the local cyberspace administration within ten working days. This registration represents an administrative filing for subsequent supervision.
Liability Mitigation
Contractual protections embedded within the standard contract framework allocate clear responsibilities between the domestic exporter and the overseas recipient. Relying on commercial contract exemptions does not absolve the domestic exporter from liability if the overseas recipient mishandles the transferred data. The domestic party must monitor the data processing activities of the foreign recipient and take immediate remedial action if a security breach occurs.
Regulatory compliance under this framework requires proactive and continuous oversight rather than a single filing event, ensuring that data subjects can pursue remedies directly against the exporter in Chinese courts.
