Specific conditions for payment arise when the beneficiary presents a written demand stating that a contractual breach has occurred. In a commercial bank guarantee, the bank is generally not required to verify the underlying facts of the breach before paying. Its obligation is independent of the underlying commercial contract between the buyer and the seller.
This independence ensures that payment is swift and bypasses prolonged litigation regarding the details of the default. The only defense against payment is a clear case of fraud supported by evidence that the demand is made in bad faith.

Banking authorities in China supervise the issuance of these instruments to prevent excessive risk accumulation. A commercial bank guarantee must be recorded in the internal systems of the lender and reported to the central credit registry. These rules protect the stability of the financial system by ensuring that contingent liabilities are properly accounted for on the balance sheet.
Expiry Condition
Protection ends on a predefined date stated clearly in the text of the document. After the commercial bank guarantee reaches its maturity, the beneficiary loses the right to make a claim for payment. The applicant must then ensure that the bank cancels the facility to release any collateral held against it.
This time limit prevents the bank from carrying perpetual risk for a completed project.
