Meaning
Mandatory regulatory accreditation for Chinese testing laboratories ensures that analytical results issued to the public are legally valid and accurate. A laboratory holding the CMA certification has demonstrated to provincial authorities that it possesses the required equipment and qualified personnel to perform specific tests. The resulting documents carry the official seal, which is required for any test report used in judicial or administrative proceedings within China.
This makes it indispensable for quality disputes.
Statutory Authority
Compliance with the Metrology Law of the People’s Republic of China requires that any third-party testing agency issuing reports for market supervision or quality arbitration must secure this seal. The CMA certification is granted by the State Administration for Market Regulation at the provincial level. Laboratories without this approval cannot issue legally binding reports.
This restriction applies to all testing carried out on industrial goods.
Technical Audit
Applicants must undergo a rigorous on-site assessment by a panel of government-appointed experts. This evaluation determines whether to grant the CMA certification by verifying the precision of instruments, the calibration records, and the qualifications of the technicians.
Commercial Protection
Foreign purchasers who face material disputes with Chinese manufacturers must rely on laboratories holding the certified status to compile evidence for Chinese courts. Reports lacking the CMA certification are routinely dismissed by judicial bodies during contract disputes. If a factory delivers non-conforming steel, a certified report is the only instrument that establishes a breach of contract under Chinese civil law.
This leaves buyers without an accredited report with no viable legal remedy in domestic courts, as the court will reject uncertified claims.
