Financial collateral provided by a licensed bank on behalf of an importer ensures the payment of customs duties or import taxes to the General Administration of Customs of China. The use of a bank guarantee tax security allows manufacturing companies to clear imported raw materials or machinery through customs before the final tax assessment is completed. This mechanism replaces cash deposits with a bank credit line, freeing up working capital during clearance delays.
Financial Arrangement
The commercial bank issues a letter of guarantee to the local customs office, promising to pay the full tax liability if the importer defaults on their obligation. The importer must pay a guarantee fee to the bank and may need to provide counter-security or collateral depending on their creditworthiness. This guarantee can be issued under the single-transaction model or as a multi-port consolidated guarantee that covers transactions across different customs districts in China.
The consolidated option is managed through the China International Trade Single Window, which coordinates the credit allocation among different ports in real time. This arrangement remains active until customs issues the final duty payment receipt and releases the bank from its liability.
Operational Benefit
Production facilities avoid costly delays at the port of entry because customs releases the goods immediately upon receipt of the bank instrument. The factory can maintain its assembly schedules while the valuation of the imported goods is negotiated or audited. This acceleration is especially valuable for high-value components or perishables.
Customs Dispute
If customs determine that the imported goods are subject to higher tariffs than declared, the importer must pay the difference or the bank will be required to pay the secured amount. The bank holds the right to recover any such payment from the importer immediately. This recovery process avoids the disruption of administrative seizures of factory assets during ongoing tax disputes.
