Judicial preservation measures under Chinese civil procedure allow a litigant to secure the assets of a respondent before or during trial to prevent the dissipation of property. An asset freeze order issued by a People’s Court restricts the transfer, disposal, or encumbrance of specific holdings during the litigation process. The measure applies to real estate, machinery, bank accounts, and equity stakes, with the scope limited to the value of the underlying claim.
It terminates when the court lifts the restriction or when the final judgment is executed.
Judicial Authority
Court rulings in these matters derive from the Civil Procedure Law of the People’s Republic of China. The applicant must demonstrate that the lack of an asset freeze order would make the enforcement of a subsequent judgment highly difficult. Security must typically be provided by the applicant to cover potential losses.
Respondent Remedy
Affected parties have the statutory right to challenge the preservation measure through a formal reconsideration application to the same court. Filing for reconsideration does not suspend the execution of the asset freeze order while the challenge is under review. The respondent can secure the release of the frozen assets by providing equivalent alternative counter-collateral to the court.
This alternative often takes the form of a bank guarantee or a cash deposit that satisfies the court’s valuation requirements.
Operational Boundary
Enforcement of the measure relies on direct coordination between the People’s Court and registration authorities or financial institutions. Banks and company registries must comply with the judicial directive upon receiving the formal ruling and assist-execution notice. The freezing period varies by asset class, lasting up to one year for bank accounts, up to three years for real estate, and up to three years for equity interests.
Extensions are possible if the applicant files a renewal petition before the expiration of the initial term, but failing to do so results in the automatic lifting of the restriction. This automatic release restores full disposal rights to the respondent.
