Tax authorities possess the statutory power under the Tax Collection Administration Law to request immigration border exit restrictions against legal representatives and responsible corporate officers of enterprises carrying unsettled tax arrears.
Public security bureaus and supervisory commissions independently impose border exit bans on individuals implicated in open criminal investigations or state anticorruption inquiries.
Execution Protocol
Implementation protocols connect the ordering administrative authority or judicial body directly with the National Immigration Administration via the national integrated border control database. Once the intermediate or basic people’s court approves a creditor’s petition for an exit ban, the court transmits an execution order to the entry-exit border inspection authority. Target foreign or domestic individuals receive no mandatory advance administrative notification prior to attempting departure at Chinese customs checkpoints.
