Discrediting Process
Raising the challenge requires the objecting party to submit a formal written motion detailing the inconsistencies in the witness’s statements. Under a Witness Perjury Challenge, the applicant must pinpoint specific discrepancies between the oral testimony and other documentary or digital evidence. This submission must be made before the court closes the evidentiary hearing.
Forensic Confrontation
The tribunal evaluates the challenge by comparing the disputed testimony against independent records, such as email logs, bank transactions, or forensic database extractions. In a Witness Perjury Challenge, the court may conduct a supplemental examination of the witness to clarify the points of conflict. This questioning helps the judge determine if the discrepancy arose from a deliberate attempt to mislead the court.
Legal Sanction
