The rate is fixed by national tax administration laws and cannot be adjusted by local tax bureaus.
Administrative Enforcement
The tax bureau enforces the collection of these fees through electronic account blocks or by withholding tax clearance certificates. When a company incurs a tax late payment surcharge, the local tax portal will restrict the company’s ability to issue official invoices to its customers. This restriction halts business operations, making the quick payment of both the principal tax and the accumulated surcharge necessary for business survival.
Dispute Resolution
Taxpayers can appeal the penalty if they can prove that the delay was caused by force majeure or administrative errors on the part of the tax authority. However, to file an appeal against the tax late payment surcharge, the company must first pay the outstanding tax and surcharge in full before the administrative review board will accept the case. This pay-first requirement represents a major cash flow barrier for financially distressed firms during a corporate restructuring.
If the appeal is successful, the tax authority will refund the overpaid amount, but the process can take several months to resolve.
