Meaning
Formal administrative procedures required before an entity can remit foreign currency out of China confirm that all applicable taxes have been paid to the local authorities. The process of tax clearance registration involves submitting a record of the transaction to the State Taxation Administration via an online portal. This step is mandatory for outbound payments exceeding fifty thousand dollars, such as service fees, royalties, dividends or interest payments.
It functions as a check to ensure that the domestic tax liability has been satisfied before capital leaves the jurisdiction.
Filing Prerequisite
The payer must provide the underlying contract and the relevant invoices to the tax bureau to justify the payment. These documents are reviewed to determine the appropriate withholding tax rate for the foreign recipient. Once the tax clearance registration is filed, the system generates a serial number that the bank uses to process the transfer.
Remittance Approval
Banks in China act as the primary enforcers of foreign exchange controls and will not execute a payment without the digital filing record. This mechanism connects the tax system directly to the banking system to prevent the unauthorized outflow of funds. The registration does not constitute a final approval of the tax amount, but it allows the funds to move while the bureau retains the right to audit later.
Audit Exposure
Subsequent reviews of the transaction can lead to demands for additional tax if the bureau determines the contract was mischaracterized. The registration record remains in the system as a permanent history of the remittance. Companies often maintain detailed files to support these registrations during future inspections.
