The applicant must submit a formal request for this examination within three years from the earliest priority date of the application. If the request is not filed and the fee is not paid within this statutory period, the application is deemed withdrawn. Statutory Test
Examiners evaluate the application against the benchmark of the prior art available anywhere in the world before the filing date. Novelty requires that the invention does not exist in any publication or public use.
