Initiating a statutory security assessment is also mandatory for any operator of critical information infrastructure. This legal prerequisite ensures that vital data assets are not exposed to foreign jurisdictions without explicit state approval.
The assessment remains valid for two years unless operational conditions change.
Execution Procedure
The enterprise begins the process by conducting a self-assessment and compiling a risk report for submission to the provincial cyberspace administration. Provincial officials review the documents before forwarding them to the national branch of the Cyberspace Administration of China for the final evaluation. Throughout this statutory security assessment, regulatory bodies analyze the contracts and the security protocols of both the sender and the receiver.
The procedure typically requires several months of administrative review before an approval or rejection is issued.
