Statutory release from the legal obligation to pay economic compensation upon the termination or expiration of an employment contract constitutes an exceptional enterprise defense under the Labour Contract Law of the People’s Republic of China. A verified severance exemption allows an employer to dissolve an employment relationship without disbursing the standard statutory allowance of one month of salary per year of service stipulated under Article 47. This rule applies strictly across mainland manufacturing, retail, technology and logistics operations governed by local labour regulations.
It does not apply to unilateral operational terminations driven by redundancy, employer relocation, corporate liquidation or negotiated mutual separations where management initiates the departure.
Statutory Ground
Chinese employment legislation restricts the grounds for non-payment of termination compensation to an exhaustive statutory list. The primary basis for severance exemption appears under Article 39, which covers proven employee wrongdoing, including gross misconduct, material dereliction of duty resulting in substantial enterprise losses, unauthorised concurrent employment, fraudulent misrepresentation during hiring, or formal criminal prosecution. A separate ground exists under Article 46 item 5, which relieves an employer of severance obligations when a fixed-term contract expires, provided the employer offers to renew the agreement on terms equal to or superior to the existing contract and the employee refuses the renewal.
Voluntary resignations submitted under ordinary circumstances without statutory employer breach under Article 37 also eliminate severance obligations. Resignations provoked by employer violations under Article 38 never qualify for an exemption.
Evidentiary Threshold
Securing an operational release from severance payments requires the enterprise to assemble unambiguous contemporaneous documentation before notifying the employee of dismissal. For misconduct grounds, employers must substantiate the exact regulatory violation against employee handbooks that were legally ratified through democratic consultation and verified individual delivery. Tribunals evaluate the objective severity of the breach, requiring financial audit trails, inventory reconciliations, forensic network logs or witness statements to confirm direct losses.
In contract expiration scenarios, the employer must produce formal written renewal notices confirming that offered wage levels, job titles and benefit structures match or exceed existing contractual standards. If the enterprise fails to provide auditable proof of a qualified renewal offer before the contract expiration date, arbitration committees automatically order full statutory severance.
Arbitral Scrutiny
Labour dispute arbitration committees and basic people’s courts approach every assertion of severance exemption with institutional skepticism, viewing statutory compensation as a baseline social protection. Adjudicators scrutinise whether enterprise disciplinary codes clearly classified the specific infraction as a gross violation, invalidating penalties based on broad catch-all provisions. If an employer attempts to avoid severance by pressuring a worker into signing a handwritten resignation letter, tribunals inspect communications for evidence of duress, misrepresentation or coercion.
An unsuccessful assertion of an exemption typically leads to a judicial finding of unlawful termination under Article 87, transforming a basic severance exposure into a punitive double severance award. Judicial practice maintains that the burden of proving every condition of non-payment rests solely on the enterprise, leaving zero presumption of validity in favor of management.
