Crossing fixed statutory duration thresholds can trigger permanent establishment status, subjecting the foreign company to Chinese corporate income tax.
Tax Withholding
Domestic clients receiving cross-border services must withhold value-added tax and surcharge taxes when remitting payments to foreign service providers. Operating under remote service delivery requires clear contract terms specifying whether service fees are net of Chinese taxes or subject to gross-up provisions. Operational Limit
Certain regulated sectors, such as onshore data center operations and specific telecommunications services, cannot be legally fulfilled solely through offshore digital channels due to licensing restrictions.
