Meaning
National legislative framework defining the security obligations of network operators and the protection of personal information. Enacted in 2017, the prc cybersecurity law establishes the legal basis for data localization and the monitoring of network traffic. It applies to any entity that owns or manages a network within the territory.
Critical Infrastructure
Organizations operating in sectors like energy, finance, transport and telecommunications are designated as operators of critical information infrastructure. These entities face stricter security reviews and more frequent audits by the Cyberspace Administration of China. They must conduct annual security assessments and report the findings to the relevant authorities.
Data Localization
Personal information and important data collected within the country must be stored on domestic servers. Exporting such data requires a security assessment by the government if the volume exceeds specific thresholds. This requirement ensures that data generated by residents remains within the reach of local law enforcement.
Liability Framework
Legal penalties include fines reaching five hundred thousand yuan for the entity and fifty thousand yuan for the responsible individual. Directors and managers can be held personally liable for systemic security failures. In extreme cases, the authorities have the power to shut down websites or revoke the business license of the offending operator.
