Meaning
A legal right allows a service provider to retain possession of a debtor’s movable property until the outstanding maintenance fees are fully paid. The statutory basis of the possessory repairman lien is established under the civil code of the people’s republic of china to protect industrial contractors. This lien arises automatically when the service is completed.
Statutory Right
Technicians can exercise this right when the owner of the machinery fails to pay the agreed service fees within the contractually specified period. For the possessory repairman lien to be legally enforceable, the contractor must retain continuous physical possession of the asset. If the contractor returns the machinery to the factory of the owner, the lien is extinguished, and the repairer becomes an unsecured creditor.
This continuous control is the defining element of the security interest.
Priority Position
Under the rules of the civil code, a possessory lien takes priority over pre-existing registered mortgages or purchase money security interests on the same machine. This super-priority status ensures that the technician who added value to the asset is compensated before financial lenders receive their distributions. If the owner files for bankruptcy, the repairer holds a secured claim on the retained equipment up to the value of the repair work.
This legal protection is one of the strongest remedies available to service providers.
Operational Remedy
If the payment remains unpaid after a statutory waiting period of sixty days, the repairer has the right to sell the asset through a public auction or convert it to their own ownership. This sale provides a direct cash remedy to cover the unpaid service fees. This disposal must follow civil court guidelines to protect the interests of the owner.
