Voluntary contracts between an employer and an employee in China terminate the labor relationship through a negotiated settlement rather than a unilateral discharge or a standard resignation. This mutual separation agreement allows both parties to agree on the timing and the financial terms of the departure, often avoiding the rigid constraints of statutory termination. It governs the payment of severance, the release of all legal claims and the handover of company property or confidential information.
The boundary for these agreements is the voluntary consent of both parties, which must be documented in writing to be legally binding. If the agreement is reached, it replaces the original labor contract and sets the final conditions for the exit. This method is the most common way to resolve employment disputes and ensure a smooth transition for both the individual and the organization.
Negotiated Compensation
The amount of money paid to the employee is often the central element of the negotiation. This mutual separation agreement usually includes the statutory economic compensation as a baseline, but the parties can agree to a higher amount to secure a quick and amicable exit. The package may also include payments for unused annual leave, performance bonuses or a special separation allowance.
