Registration Registry
The online registry operates on a centralized national basis, replacing the old fragmented system that was managed by multiple local government bureaus. Under the regulations of the movable property system, a secured party must register their interest by filing a financing statement online. This registration must describe the collateral with sufficient specificity to alert potential future creditors.
The registry is publicly searchable and updates in real-time.
Priority Order
Legal priority among competing claims is determined strictly by the order of registration in the centralized database. Within the movable property system, the first creditor to successfully register their security interest has the first right to the asset’s value. This clear rule eliminates the ambiguity that previously caused long disputes among multiple banks during a borrower’s default.
Unregistered security interests are subordinate to registered ones, regardless of the date the loan agreement was signed.
Enforcement Action
Secured creditors can initiate streamlined recovery procedures to seize and liquidate the registered collateral if the debtor fails to repay the loan. Under the administrative rules of the movable property system, the creditor can apply directly to the court for execution without undergoing a full-scale trial if the mortgage contract is notarized with an enforcement clause. This administrative pathway allows the lender to bypass lengthy civil litigation and secure the assets for auction.
The proceeds are then applied to the outstanding debt according to the registered priority order.
