Fiscal levy additions involve secondary taxes calculated as a percentage of the primary turnover taxes such as value added tax and consumption tax to fund specific local government services. Local surtaxes are a group of municipal and provincial charges that must be paid by every business entity operating within the People’s Republic of China. They govern the funding of urban maintenance, education initiatives and local infrastructure projects through a piggyback mechanism on the national tax system.
The boundary of these taxes is defined by the location of the taxpayer, with different rates applying to urban areas, townships and rural districts. This mechanism ensures that local governments have a stable source of revenue that scales with the economic activity of the businesses in their jurisdiction. It applies to every tax filing period where a positive amount of value added tax or consumption tax is due.
These surtaxes are mandatory and are collected by the State Taxation Administration alongside the primary taxes.
Calculation Base
Mathematical determination of the amount due is based directly on the actual liability of the taxpayer for the underlying turnover taxes. When a company calculates its local surtaxes, it takes the total value added tax and consumption tax paid for the month and multiplies it by the applicable surtax rates. The most common components are the Urban Maintenance and Construction Tax, the Education Surcharge and the Local Education Surcharge.
For a company located in a major city, the Urban Maintenance and Construction Tax rate is typically seven percent of the primary tax amount. The national Education Surcharge is set at three percent, while the Local Education Surcharge is usually two percent. This means the total additional levy can reach twelve percent of the primary tax bill.
This linkage ensures that as the business grows and pays more in value added tax, its contribution to local services increases proportionally.
Local Allocation
Revenue from these charges is earmarked for specific public purposes within the municipality or province where the tax is collected. The Urban Maintenance and Construction Tax is specifically designated for the repair of roads, bridges and public utilities in the local area. Education surcharges are channeled into the local school system to fund teacher salaries, school construction and educational materials.
This regional focus allows taxpayers to see the direct impact of their contributions on the local environment and workforce. Because the rates and the allocation of these funds are determined by the central government but the revenue is kept by the local authorities, it is a key component of China’s fiscal federalism. Foreign invested enterprises were previously exempt from these levies, but since 2010 they have been subject to the same rates as domestic firms.
This change was part of a broader effort to create a level playing field for all market participants.
Compliance Duty
Filing obligations for these surtaxes are integrated into the standard tax returns for value added tax and consumption tax to reduce the administrative burden on businesses. Every month or quarter, a company must report its primary tax liability and the corresponding local surtaxes on the same electronic filing platform. Failure to pay these surtaxes is treated with the same severity as a default on national taxes, leading to late payment interest and administrative penalties.
The State Taxation Administration performs regular audits to ensure that the correct urban or rural rates have been applied based on the company’s registered address. If a company moves its office from a rural area to a city, it must update its tax registration to reflect the higher surtax rate. This transition is often missed by small businesses, leading to unexpected tax liabilities during a subsequent audit.
The statutory requirement for these payments is absolute and cannot be waived by local officials without central government approval.
