This bond ensures that the defendant has a clear financial remedy if the plaintiff’s lawsuit is ultimately dismissed as groundless or malicious.
Provider Underwriting
Licensed insurance companies and state-backed guarantee firms underwrite these bonds by assessing the legal merits of the plaintiff’s claim and the financial standing of the applicant. The insurer issues a formal letter of guarantee to the court, which accepts this paper instrument as an alternative to a cash deposit. This prevents the plaintiff’s operating capital from being locked up during lengthy trial proceedings.
Claim Execution
Should the court determine that the asset preservation was wrongful and caused measurable financial damage, the defendant can file a claim against the litigation security bond. The guarantor is legally obligated to compensate the defendant for the losses up to the full face value of the bond. This direct financial liability is paid out by the insurer and then recovered from the plaintiff.
Release Condition
Upon the resolution of the lawsuit in favor of the plaintiff or the voluntary withdrawal of the preservation application, the court releases the bond. The guarantor’s liability is terminated, and any collateral provided by the plaintiff is returned in full.
