Litigants use a judicial stay application to pause a case while a related matter is resolved elsewhere. In the Chinese legal system, this often occurs when a civil case depends on the outcome of a concurrent criminal investigation or a separate administrative review.
The application must clearly state the statutory grounds for the request and demonstrate that continuing the current proceedings would lead to an unjust result. If the court accepts the judicial stay application, all deadlines and hearings are put on hold until the reason for the stay is removed.
Filing Requirement
The petitioner must submit a written request that includes evidence of the circumstances justifying the delay. A judicial stay application acts as a procedural shield when filed at the court currently handling the case, although a higher court can also order a stay as part of its supervisory power. The document must describe the specific harm that would be caused if the proceedings were allowed to continue without interruption.
Courts often require the applicant to update the judge on the status of the external matter every few months to ensure the stay does not become an indefinite delay.
Review Standard
Judges examine whether the issues in the separate proceeding are truly decisive for the outcome of the current litigation. A judicial stay application is frequently rejected if the court determines that the two cases are sufficiently independent to be decided separately. The court also considers the potential prejudice to the other party, who may be harmed by a long delay in receiving a judgment.
This balancing test ensures that the stay is used to improve the accuracy of the court’s final decision rather than as a tactic for obstruction.
Operational Consequence
Once the order is granted, the clerk of the court pauses all active service of process and cancels any scheduled property auctions. The judicial stay application effectively freezes the legal status quo, preventing any party from gaining a tactical advantage through the passage of time. For a business, this might mean that frozen bank accounts remain inaccessible but are not yet transferred to the plaintiff.
The stay ends when the court issues a new notice to resume the trial, which happens immediately after the external conflict is resolved. This resumption resets the remaining time on any statutory deadlines that were active before the pause began. By managing the flow of litigation in this way, the judiciary maintains a coherent and consistent application of the law across different branches of the government.
