Meaning
Administrative dispute mechanism conducted before CNIPA to cancel or modify a granted patent right. Invalidation proceedings evaluate whether a granted invention or utility model patent fails to satisfy statutory requirements of novelty or inventive step under the PRC Patent Law. Any legal entity or individual can initiate this proceeding after patent grant by submitting prior art evidence and technical arguments to the Patent Reexamination and Invalidation Department.
The scope of review remains restricted strictly to the patent claims challenged and the specific grounds raised in the initial filing petition.
Evidentiary Assessment
Petitioners submit global prior art documents or public use records to prove lack of novelty. Evidence generated outside China requires notarization and legalization through proper diplomatic channels before submission to CNIPA panels.
Administrative Hearing
Collegial panels of technical examiners review written submissions and conduct oral hearings to evaluate claim validity. Patent holders may amend claim scopes during invalidation proceedings by narrowing specific technical features without adding new matter. Panel decisions result in full invalidation or partial invalidation of the patent right.
Judicial Review
Parties dissatisfied with CNIPA administrative decisions retain the right to file an administrative lawsuit before the Beijing Intellectual Property Court within three months of receiving the decision. The court reviews whether administrative procedures followed statutory rules and whether technical conclusions align with statutory standards. Appeal decisions from the Beijing IP Court proceed to the IP Court of the Supreme People’s Court for final judicial adjudication.
Sustained invalidation rulings operate retroactively, eliminating legal grounds for past or pending infringement claims.
