Challenges start with a detailed submission of prior art that demonstrates why the original claim fails to meet statutory requirements. In an invalidation action, the petitioner presents evidence such as older scientific papers, existing patents or records of prior public use to show that the technology was already in the public domain. Inventiveness is a high bar, meaning the target patent must not be an obvious combination of existing things to a person skilled in the technical area.
The respondent then has the opportunity to defend their property by narrowing the scope of their claims or pointing out unique differences. Success leads to the complete or partial removal of the patent rights from the public register. This effectively permits other companies to use the previously restricted technology without fear of infringement suits.
Procedural Workflow
Sequential steps guide the case from the initial filing to the final determination by the examiners. After the submission of an invalidation action, the board conducts an initial review to ensure the evidence is admissible and the petition is correctly formatted.
