Meaning
A specialized judicial tribunal handles technical intellectual property disputes across Chinese manufacturing and technology hubs. Created by decisions of the National People’s Congress Standing Committee and supervised by the Supreme People’s Court, an intellectual property court possesses cross-regional jurisdiction over complex patent, trade secret, software, and plant variety disputes. Specialized tribunals operate in major industrial centers including Beijing, Shanghai, and Guangzhou, with an appellate tribunal established directly within the Supreme People’s Court.
These specialized courts aim to unify judicial standards and improve expert adjudication in technical litigation.
Technical Patent Jurisdiction
Specialized IP courts possess exclusive first-instance jurisdiction over civil and administrative cases involving patents, utility models, new plant varieties, integrated circuit designs, and technical trade secrets within their designated geographic zones. Standard district courts are bypassed for technical civil litigation to ensure case management by experienced IP judges. Appeals from these specialized regional courts go directly to the Supreme People’s Court Intellectual Property Court in Beijing, bypassing provincial high courts to maintain nationwide legal consistency.
Technical Investigator Role
Litigation procedures utilize technical investigators who advise judges on engineering, chemical, and software evidence. These technical investigation officers participate in court hearings, examine physical specimens, and draft technical evaluation reports for the judicial panel. Courts also employ preliminary injunctions, evidence preservation orders, and document production orders to prevent destruction of manufacturing evidence prior to trial.
Damage awards have increased following statutory amendments that introduce punitive damages up to five times actual losses for intentional infringement.
Judicial Injunction Remedy
Administrative and judicial enforcement integration offers foreign patent holders legal remedies against manufacturing infringement in China. Specialized judicial panels speed up dispute resolution for international supply chain operators.
