Economic Substance
Tax bureaus verify that the licensed intellectual property actually provides an economic benefit to the domestic entity’s manufacturing process. Remittances are disallowed if the underlying patent or trademark has already expired or does not contribute to local revenue generation.
Transfer Pricing
The transfer pricing analysis focuses on whether the royalty rate matches the rate that independent enterprises would agree to under similar conditions. Investigators evaluate the development, enhancement, maintenance, protection, and exploitation of the asset to decide which entity holds the true economic ownership. If the local subsidiary is found to be paying royalties for assets it helped develop, the tax authority will adjust the tax base and demand additional enterprise income tax.
Remittance Control
Remittances require the submission of a registered trademark or patent license contract to the local tax bureau and the commercial bank. The bank will block any royalty payment that lacks the required registration and withholding tax receipts.
